BLUSH PRIVACY POLICY
This privacy policy applies to Blush Media, LLC (“Blush”) products, services and websites (“Services”). This privacy policy does not apply to affiliated sites or companies, links, advertisements or third party sites or companies. Blush is not responsible for the actions or privacy policies of other sites.
Information Collection and Use
Blush collects a variety of information from numerous sources to provide you with a high quality, interactive experience when engaging and communicating with the Blush community:
Registration Information
Blush collects and stores any personal information you provide when you register, create a profile, sign up for newsletters, or any other registration to use Blush Services. Registration information may include your name, email address, physical address, zip code, telephone number, birth date, gender, occupation, and other personal information. You may not be required to provide certain registration information, however, by doing so you may not be able to take full advantage of certain features and functionalities of Blush Services. For quality performance and delivery of the Services, Blush may combine the information you submit with information acquired from other Blush services or third parties.
Blush will not rent, sell or license any of your personal information to any third parties. Notwithstanding the foregoing, Blush may transfer your personal information as part of an acquisition, merger or sale of the business assets of Blush.
Computer and Browser Information
Blush automatically collects information from your computer and browser when you visit Blush sites. This information typically includes your request page, the time and date of the request, IP address, browser type, Blush cookie information, and software and hardware attributes. Such information is used to track user trends and preferences and to improve the quality of our services.
Cookies
A cookie is a small piece of data that holds unique information about a user. Blush uses cookies to identify your browser by storing specific information on your computer. A temporary cookie is used to confirm your log-in status and is terminated once your browser is closed. Blush also uses a persistent cookie that stores your log-in information for easier profile access each time you return to the Blush community. By default, most browsers are set up to accept cookies. You may reconfigure your settings to disable cookies. However, disabling cookies may prevent certain Blush services from operating properly. Cookie data is used for efficiency and informational purposes to enhance your experience with the Blush community.
User Information
Blush collects user information related to your use of the Services. This may include personal profile activity, community searches, group information and enrollment, product review, newsletter registration, interaction and connection with other Blush members via blogs, emails, message boards, published editorial, video and image content, and other activity using various other channels.
User information allows Blush to analyze trends, track user behavior and gather broad demographic information to customize and modify content, features and services and to enhance overall user experience within the Blush community. Certain profile and registration information will be publicly displayed to visitors and other community members primarily to connect you with and give access to others in the Blush community.
User Generated Content
User generated content is posted at your own risk. The content and information you post will be displayed publicly, together with your name and display image, across the Blush network and third party sites via APIs. Due to the nature of online communities we cannot control the actions of other users with whom you choose to communicate and share your information, profile and posts. Other users may supplement your profile and blogs by posting additional comments in response to the information you generate. We cannot guarantee that user content you post on Blush will not be viewed by unauthorized persons. You acknowledge that no security measures are perfect or impenetrable. We are not responsible for circumvention of any privacy settings or security measures contained on Blush. You understand and acknowledge that, even after removal, copies of your user content may remain viewable in cached and archived pages or if other users have copied or stored your user content.
Opt-in/Opt-out
If information is used for any purpose other than that described in the policy and/or in notices, you will be given the choice to opt-out.
From time to time, Blush will deliver information using your name and address through promotional materials, notifications or category specific newsletters. You may choose to opt-out of these services.
Disclosure and Sharing of Information
Blush is a media site based on building communities around shared content and interests. Except as otherwise permitted herein, we do not disclose personal information to third parties without your permission. We believe disclosure may be reasonably necessary under certain limited circumstances, in particular, where disclosure is (1) required by applicable law, regulation, legal process, court orders, or to establish legal rights or defend against claims; (2) used to prevent, investigate, or take action related to illegal activities, suspected fraud, potential threats, violations of terms of use, or as otherwise required by law; and (3) with your consent.
In addition, we share information with trusted partners and affiliated companies who work on behalf of or with Blush under confidential terms. We do not disclose your identity, but merely share general, aggregated, non-personal information to help communicate offers, track trends, develop new services and improve the overall quality of Blush services.
Third Party Advertising
Advertisements that appear on Blush websites may be delivered, or “served,” by third party advertisers. When an advertisement is served, advertisers (1) automatically receive your IP address, (2) may download cookies to your computer, and/or (3) use other technologies, such as JavaScript, web beacons, pixels, or 1x1 gifs to measure the effectiveness of their ad campaigns. Blush has no access to or control of third party actions. Third party advertisers do not have access to your contact information without your consent.
Access
When you create a Blush profile, you will have access to your personal information and privacy settings. You can restrict or authorize others to access your information through profile editing tools which allow you to modify or delete account information and preferences. Deactivated accounts and deleted information may remain in backup files for a reasonable period of time but will not be generally available to the Blush community. Content created on blogs, IM, email and other profile pages will remain and will not be removed.
Age Restrictions
Blush is a general audience site and does not knowingly collect personal information from children under the age of 13 without verification of parental consent.
Confidentiality and Security
Confidential information is restricted to Blush employees, agents or contractors who (1) require access in the course of their assigned duties and responsibilities, and (2) have agreed in writing to be bound by a confidentiality agreement.
Blush has implemented physical, electronic and procedural safeguards in compliance with federal regulations to protect against the unauthorized use of information. Blush reviews its data collection, storage and processing practices to ensure that we only collect, store and process the personal info needed to provide or improve services.
Copyright Infringement
Blush respects the intellectual property of others, and ask our users to do the same. Blush may, in appropriate circumstances and at its discretion, disable or terminate the accounts of users who may be infringing the intellectual property rights of others. If you believe that your work has been copied and is accessible on this site in a way that constitutes copyright infringement, please provide Blush the following information at the contact information set forth below:
1. An electronic or physical signature of the copyright owner or person authorized to act on behalf of the owner of the copyright;
2. A description of the copyrighted work that you claim has been infringed and a description of the infringing activity;
3. A description of where the material that you claim is infringing is located on the site, for example, the URL address of the website where it is posted;
4. Your name, address, telephone number, and email address;
5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
6. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
